StubHub, Inc. Daytona on 2/19/2006 Official Giveaway Rules
Please read these rules before entering the Giveaway.
- Eligibility. NO PURCHASE NECESSARY TO ENTER OR WIN. GIVEAWAY OPEN ONLY TO RESIDENTS OF THE UNITED STATES EXCLUDING RHODE ISLAND OVER THE AGE OF 18. IF YOU ARE NOT A RESIDENT OF THE UNITED STATES (EXCLUDING RHODE ISLAND), YOU ARE NOT ELIGIBLE TO WIN A PRIZE, AND STUBHUB RESERVES THE RIGHT NOT TO AWARD PRIZES TO ENTRANTS WHO RESIDE IN OTHER JURISDICTIONS. To be eligible to win a prize, entries must be completed and received by StubHub, Inc. ("StubHub") in the format designated below. Directors, officers and employees of StubHub and any of their respective affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies and immediate families of each are not eligible to win any prizes. All applicable federal, state and local laws and regulations apply. Offer void where prohibited. Limit one entry per person. Multiple entries by the same person using more than one email account will not be accepted. No mechanically or electronically reproduced entries will be accepted.
- Disclaimer. StubHub, all participating sponsors and all of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies will not be responsible for: (a) any late, lost, misrouted, garbled, distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet or other computer- or communications-related malfunctions or failures; (c) any Giveaway disruptions, injuries, losses or damages caused by events beyond the control of StubHub; or (d) any printing or typographical errors in any materials associated with the Giveaway.
- Giveaway Period. The Giveaway period is from 1/16/2006 to 2/10/2006 (the "Deadline"). All entries must be received by the Deadline to be eligible to win a prize.
- Prizes. 2 (Two) Tickets to Daytona on 2/19/2006 at the Daytona International Speedway in Daytona Beach, FL, $1500 for Hotel and Travel.
Odds of winning a prize depend on the number of eligible entries received. One (1) entry per person. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER.
All prizes will be awarded. Prizes returned as undeliverable or otherwise not claimed within 2 days after delivery of notification will be forfeited and awarded to an alternate winner. Prizes are not transferable. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that StubHub reserves the right to substitute a prize of equal or greater value for any prize. Limit one prize from StubHub per household or address per year. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose. - How to Enter. No purchase necessary. Void where prohibited. Must be 18 years of age and a resident of the United States, excluding Rhode Island, to enter. By entering the Giveaway, you consent to being placed on a mailing list for promotional and other materials. You will be subscribed to StubHub's Ticket Update newsletter. To unsubscribe follow the instructions at the bottom of the Ticket Update newsletter at any time.
- Giveaway Rules. Prize winners will be determined by a random drawing from all eligible entries, to be held at StubHub's corporate headquarters on 2/11/2006. Winners will be notified by email. To claim a prize, winners must respond to such email within the time stated in the email.
- General Release. By entering the Giveaway, you release StubHub, participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the "Released Parties") from any liability whatsoever, and waive any and all causes of action, for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Giveaway or acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.

Winner's guest must be at least 18 years of age prior to winner's taking the trip unless Winner is the parent or legal guardian of the guest. Winner is responsible for ground transportation to and from the airports, hotel and event(s), all meals and all other expenses that winner or winner's guest incurs in connection with the trip.]
- Use of Winner's Name, Likeness. Except where prohibited by law, entry into the giveaway constitutes permission to use winner's name, likeness and prize information, without limitation, for promotional purposes without further permission or compensation. As a condition of being awarded any prize, except where prohibited by law, winners may be required to execute a consent to the use of their name, address, likeness and prize information, without limitation, for promotional purposes without further permission or compensation.
- Affidavit and Release. As a condition of being awarded any prize, winners will be required to execute and deliver to StubHub a signed affidavit of eligibility and acceptance of these Official Rules and release of liability.
- Winners List; Rules Request. For a copy of the winners list, send a stamped, self-addressed, business-sized envelope after 2/11/2006 and before the first anniversary of such date to StubHub at 55 Second Street, Suite 300, San Francisco, California 94105, Attn: Sweepstakes Administrator, Winners List. To obtain a copy of these rules, send a stamped, self-addressed, business-sized envelope after 1/16/2006 and before the first anniversary of such date to StubHub at 55 Second Street, Suite 300, San Francisco, California 94105, Attn: Sweepstakes Administrator, Rules Request. Residents of Washington and Vermont may omit return postage.
- Copyright Notice. The Giveaway and all accompanying materials are copyright 2005, StubHub.
- Miscellaneous. The Giveaway and these Official Rules will be governed, construed and interpreted under the laws of the State of California without respect to such states' laws governing the conflict of laws. Entrants agree to be bound these Official Rules and the decisions of StubHub, which are final and binding in all respects. StubHub reserves the right to changes these Official Rules at any time, in its sole discretion, and to suspend or cancel the Giveaway or any entrant's participation in the Giveaway should viruses, bugs, unauthorized human intervention or other causes beyond StubHub's control affect the administration, security or proper play of the Giveaway or if StubHub otherwise becomes (as determined in its sole discretion) incapable of running the Giveaway as planned. Entrants who violate these Official Rules, tamper with the operation of the Giveaway or engage in any conduct that is detrimental or unfair to StubHub, the Giveaway or any other entrant (in each as determined in StubHub's sole discretion) are subject to disqualification from entry into the Giveaway. StubHub reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Giveaway. - Force Majeure. StubHub reserves the right to change, suspend or cancel the Giveaway if, in StubHub's sole discretion, intervening circumstances warrant such change, suspension or cancellation. Intervening circumstances include, but are not limited to, interruption, preemption or cancellation of StubHub's service due to conditions beyond StubHub's reasonable control such as strike, labor dispute, war, insurrection, revolution, terrorism, riot or other civil disturbance, earthquake, fire, flood or other natural disasters, governmental restrictions, embargoes or other exercises of governmental authority, unavailability of supplies, components or material or any other cause beyond Sponsor's control.
- Giveaway Sponsor. The sponsor of the Giveaway is StubHub, Inc., 55 Second Street, Suite 300 San Francisco, California 94105. StubHub is an online marketplace through which fans can buy and sell tickets to live events.
